General terms and conditions of sale
Scope of application
The general terms and conditions of sale are intended to govern the relationships between Le Domaine du Brantard and the internet user, hereinafter referred to as the customer. The sending of the customer's order implies their acceptance of these general terms and conditions of sale in their entirety, to the exclusion of any other terms or conditions. The customer declares that they have the capacity to contract with Le Domaine du Brantard based on the general terms of sale. They guarantee that all information provided is accurate.
Prohibition of sale to minors
By accepting the general terms, the customer certifies that they are at least 18 years old. Indeed, the law prohibits the sale of spirits, aperitifs, and alcopops to persons under 18 years of age, as well as the sale of wines, ciders, and beers to those under 16 years.
Products
The characteristics of the items and explanatory notices are provided for informational purposes only and do not constitute contractual documents. The photos appear on the site www.domainedubrantard.ch for illustration purposes and do not form part of the contractual conditions. Le Domaine du Brantard disclaims any responsibility for any errors or omissions related to the images or notices appearing on its online store.
Prices and conditions of sale
The prices indicated on the site www.domainedubrantard.ch are in Swiss francs (CHF) per bottle and include VAT. The prices include all taxes and are ex-cellar, excluding delivery charges.
Le Domaine du Brantard reserves the right to modify its prices at any time. However, the price charged is the price displayed at the time of the order.
The promotional discounts offered as part of commercial actions on the site www.domainedubrantard.ch are deducted directly from the invoice amount.
The offers on products are only valid as long as they are visible on the site www.domainedubrantard.ch and within the limits of available stock.
All orders are final as soon as payment by credit card has been confirmed.
Any order must be paid in advance by credit card or upon request by bank transfer or invoice.
Prices and conditions of sale
The products are sent to the delivery address provided by the customer during the ordering process. FOR ANY SPECIAL OFFER OR SPECIAL DISCOUNTS, DELIVERY CHARGES ARE ALWAYS APPLIED REGARDLESS OF THE ORDER AMOUNT.

Standard delivery (without signature):
from 1 to 18 bottles - 12.90 CHF
More than 18 bottles 22.- CHF
The carrier leaves the goods at the door. Domaine du Brantard disclaims all responsibility if they are damaged or stolen before the customer retrieves them.
Delivery against signature:
from 1 to 18 bottles - 14.40 CHF
More than 18 bottles 22.40 CHF
The carrier delivers the goods to the customer in person against a signature.
Customers wishing to collect their order at the Domaine must come during the opening hours of the cellar.
DELIVERY CHARGES FOR SPECIAL OFFERS (flash offers/ end of lots): for any special offer or special discount, delivery charges are always applied regardless of the order amount. Depending on the nature of the offer, they may however be waived if Le Domaine du Brantard decides so.
Secure payment and data protection
All payments made online are secure. The information entered for payment is encrypted (https) and transmitted to Odoo securely.
The use by Le Domaine du Brantard of personal data relating to customers complies with current legislation, particularly the data protection law. This data is processed confidentially and securely.
Le Domaine du Brantard only processes and retains the data necessary for the proper execution of its services. Under no circumstances is this data transmitted to third parties.
Cork taste, defective bottles
Defective bottles and/or those with a cork taste are subject to return and refund conditions explained in the article of the same name in these general conditions. Please refer to this point to be aware of these conditions.
Verification of the goods
The customer is responsible for checking the quantity and condition of the goods upon delivery. If the customer has chosen the delivery method "delivery against signature" and notes that goods are missing or have been damaged, he must report it and file a claim with the carrier and inform Le Domaine du Brantard within 7 days following delivery. Le Domaine du Brantard will then replace the missing or damaged goods with identical ones.
Return and refund conditions
Le Domaine du Brantard does not accept returns of goods. However, the customer may return products if they have a corked taste and/or if they are defective bottle(s). If the customer notices these anomalies on one or more ordered products, they will not be eligible for a refund but for a replacement, upon presentation of the invoice, provided that the corked or defective bottles are returned three-quarters full and with the original cork.
Sale by the unit
Possibility to order all products by the unit.
Ownership
The goods remain the property of Le Domaine du Brantard until full payment of the invoice.
Limitation of liability
Without limiting the scope of these general terms and conditions, no claim whatsoever regarding delivered products or services, non-delivery of products or services or otherwise can exceed the amount of the purchase price of the products or services that gave rise to a claim for damages. IN NO EVENT shall Le Domaine du Brantard BE HELD LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (EVEN IF THE OCCURRENCE OF SUCH DAMAGE WAS KNOWN OR COULD HAVE BEEN KNOWN BY Le Domaine du Brantard) ARISING IN CONNECTION WITH ITS PRODUCTS OR SERVICES, THEIR USE, THEIR SALE OR THIS SITE.
Applicable law and legal jurisdiction
In the event of a dispute, the general terms and conditions in force at the time of purchase are used as the legal basis. These general terms and conditions are governed by Swiss law, in particular by Articles 184 and following of the Swiss Code of Obligations, to the exclusion of any other foreign legislation.
In the event of a dispute, the competent jurisdiction is at the legal venue of Domaine du Brantard, Route des Cigognes 12 bis, 1135 Denens.
Validity and modifications of the general conditions
The list of wines is subject to sale in the meantime. Domaine du Brantard reserves the right to modify the assortment, prices, and conditions at any time and without prior notice.
